Proven Criminal Defense In Upstate New York

Defense Against Theft Or Shoplifting Charges

Many people don’t realize just how seriously New York takes theft. Perhaps it’s because of the thousands of tourists who flock to the Big Apple to shop Fifth Avenue, or maybe it’s because NYC is home to Wall Street.

Regardless of the reason, those penalties extend to those of us living upstate and here in Syracuse. Four out of five theft charges are felonies in New York, and the threshold between a misdemeanor and felony isn’t that high: only $1,000. What’s more, even a misdemeanor could result in up to one year in jail.

Therefore, if you or your teen is facing theft charges, you need a skilled criminal defense attorney on your side. Michael Spano handles all types of criminal cases, from simple shoplifting charges to grand larceny. You can count on his 30-plus years of experience to protect your rights and interests.

Felony Charges Mean Higher Penalties

Theft charges are defined by the value of the alleged stolen goods. Penalties for felony theft charges — legally called grand larceny — vary based on this value. In general, those charged with grand larceny can expect:

  • Up to four years in prison and up to $5,000 in fines for goods valued between $1,000 and $3,000
  • Up to seven years in prison and up to $5,000 in fines for goods valued between $3,000 and $5,000
  • Up to 15 years in prison and up to $5,000 in fines for goods valued between $5,000 and $1 million
  • Up to 25 years in prison and up to $5,000 in fines for goods valued over $1 million

Theft charges can go hand-in-hand with other charges too, like burglary (breaking into a building or store), identity theft or financial fraud. This will only increase the penalties you face.

Experienced Help With Teen Shoplifting Charges

As mentioned above, even minor shoplifting can result in significant penalties, and don’t think your age will minimize them. In New York, teenagers aged 16 and 17 charged with crimes are considered “youthful offenders.” If caught shoplifting, teens face the same penalties and process as adults do.

Michael Spano has experience handling youthful defense cases. He will do what it takes to protect their rights and futures.
